1. Acceptance of Terms

By accessing or using SongCreator ("the Service"), operated at songcreator.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by SongCreator ("we", "us", "our").

2. Description of Service

SongCreator is a music creation and distribution platform that enables users to generate original songs using artificial intelligence, create video compilations, and distribute content to third-party platforms including but not limited to YouTube and TikTok. The Service includes:

  • Song generation (lyrics, music production, cover art)
  • Video compilation creation
  • Automated distribution to connected social media platforms
  • Content management and analytics dashboard

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information remains current and accurate

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription Plans and Billing

The Service offers subscription-based plans with varying credit allocations. By subscribing to a paid plan, you agree that:

  • Subscription fees are billed in advance on a monthly or annual basis
  • Credits are allocated per billing cycle and do not roll over
  • Prices are subject to change with 30 days prior notice
  • Refunds are handled in accordance with applicable law
  • Failure to pay may result in suspension of service

5. Content Ownership and Licensing

Your Content: You retain ownership of the themes, topics, and creative direction you provide. Songs and content generated through the Service using your inputs are licensed to you for commercial use under your active subscription.

Generated Content: Content created by the Service (lyrics, music, images, videos) is generated using third-party AI services. You are granted a non-exclusive, worldwide license to use, distribute, and monetize this content for the duration of your subscription.

Platform Content: The Service's interface, design, code, and proprietary technology remain our exclusive property and may not be reproduced, modified, or distributed.

6. Third-Party Platform Integration

6.1 YouTube

By connecting your YouTube account, you authorize SongCreator to upload videos, set metadata (titles, descriptions, tags, thumbnails), and manage content on your behalf. You acknowledge that:

7. Prohibited Uses

You agree not to use the Service to:

  • Generate content that infringes on intellectual property rights
  • Create harmful, abusive, hateful, or discriminatory content
  • Produce content that violates applicable laws or regulations
  • Engage in spam, misleading practices, or artificial engagement
  • Circumvent platform community guidelines or content policies
  • Resell, sublicense, or redistribute the Service without authorization
  • Attempt to reverse engineer, decompile, or extract source code
  • Use automated means to access the Service beyond intended functionality
  • Generate content depicting violence, explicit material, or illegal activities

8. Content Moderation and Compliance

We reserve the right to review, flag, or remove content that violates these Terms, applicable laws, or third-party platform policies. We may cooperate with law enforcement and regulatory authorities when required. Content that receives copyright claims, community guideline strikes, or policy violations on third-party platforms may result in account restrictions on our Service.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free operation of the Service
  • Accuracy, quality, or suitability of generated content
  • Successful upload or distribution to third-party platforms
  • Monetization eligibility or revenue from distributed content
  • Compatibility with future changes to third-party platform APIs

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Termination

Either party may terminate the agreement at any time. Upon termination:

  • Your access to the Service will be revoked
  • Content already published to third-party platforms will remain on those platforms subject to their respective policies
  • We may retain anonymized usage data for analytics purposes
  • Outstanding fees remain payable

11. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days prior to taking effect. Continued use of the Service after changes constitute acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
